Wedding Photography Agreement

 

ENTIRE AGREEMENT: This agreement contains the entire understanding between Kayleigh-Anne Photography and the Bride and Groom. It replaces any prior agreements that may have been made.

CONFIRMATION: A signed wedding contract and deposit are necessary to confirm the stated wedding services from Kayleigh-Anne Photography.

PRE-WEDDING CONSULTATION: This will be arranged at the time of booking or at a date arranged before the wedding. The bride and groom will outline broadly what is required and Kayleigh-Anne Photography and will advise on planning, logistics and timings where needed. If required, the bride and groom are welcome to arrange an additional chat closer to the time of the wedding to iron out the remaining details. In any case I will contact you by phone a few days before the wedding to ensure that there have been no last minute changes.

COOPERATION: The bride and groom and Kayleigh-Anne Photography consent to cheerfully cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. The bride and groom also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at wedding like having their photo taken. In such cases the wedding photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

HOUSE RULES: Note the photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. Copyright ownership of your wedding photos is transferred to the bride and Groom upon full payment under the following conditions. The digital images taken by Kayleigh-Anne Photography are for personal use by the bride and groom and their friends and relatives. If selling the wedding photos for profit the bride and groom, their friends and relatives must obtain permission from Kayleigh-Anne Photography.

 

MODEL RELEASE: The Bride and Groom grant Kayleigh-Anne Photography and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the bride and groom for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Bride and groom hereby releases Kayleigh-Anne Photography and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

LIMIT OF LIABILITY: If the photographer is too ill or becomes injured and cannot supply the wedding services specified above, Kayleigh-Anne Photography will do everything possible to book a replacement wedding photographer. If a replacement photographer cannot be found in these circumstances, liability is limited to a refund of any payments received. Kayleigh-Anne Photography have working methods in place to prevent the loss or damage to your images (the digital images are backed up constantly to separate storage media throughout the wedding, duplicate equipment is on hand in case of breakage or failure). However, there exists the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the control of Kayleigh-Anne Photography. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.

BOOKING DEPOSITS: A 25% deposit is required to confirm photography booking and date. The full photography invoice amount is due six weeks prior to the wedding date. In the event of the bride and groom cancelling the wedding for whatever reason the booking deposit is non refundable. 

CANCELLATION: Should the event be cancelled within 16 weeks of the wedding date, I understand that Kayleigh-Anne Photography may keep all monies paid as a result of declining other paid assignments. I understand that I should notify Kayleigh-Anne Photography at my earliest convenience.

CANCELLATION CONTINUED: In certain situations, if Kayleigh-Anne Photography can rebook my wedding date then all/or part of any monies (excluding the deposit) paid may be refunded back to me, subject to Kayleigh-Anne Photography’s discretion.

FORCE MAJEURE OR ACT OF GOD: The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

In the event it shall become impossible for Kayleigh-Anne photography or Client to perform their obligations under this Contract for reasons of Force Majeure, the party so unable to perform may terminate this Contract upon written notice to the other.

DELIVERY OF IMAGES: Digital images are normally ready within 4-8 weeks of the wedding.

CANCELLATIONS: If the Client decides to cancel the wedding and chooses NOT to postpone to another date, the booking fee will not be refunded.
